[205366] Ms Blears: [holding answer 16 December 2004]: For the financial year 2003-04, there were 25,692 searches made under section 44(1), Terrorism Act 2000, with 373 resultant arrests; and 8,106 searches under section 44(2), with 118 resultant arrests. Stop and search powers under the Terrorism Act are should not be evaluated using arrest statistics. The powers are used by police in areas potentially targeted by terrorists to prevent and deter attacks Further details are available in Home Office Statistical Bulletin 18/04 "Arrests for Notifiable Offences and the Operation of Certain Powers under PACE, England and Wales 2003/04" which is published by Research Development and Statistics (RDS) on the Home Office website at www.homeoffice.gsi.gov.uk/rds/ Statistics on arrests and charges from 11 September 2001 until 30 September 2004 under the Terrorism Act 2000 are available on the Home Office website at www.homeoffice.gsi.gov.uk/terrorism/. (These are compiled from recent police records and are therefore subject to change as cases go through the system.) Arrests Police records show that from 11 September 2001 until 30 September 2004, 664 people were arrested under the Terrorism Act 2000. Charges 118 of these were charged under the Act. Of these, 44 were also charged with offences under other legislation. 135 were charged under other legislation. This includes charges for terrorist offences that are already covered in general criminal law such as murder, grievous bodily harm and use of firearms or explosives. Convictions 17 Individuals have been convicted of offences under the Terrorism Act Records on the number of searches of premises and resultant charges are not collated centrally.

Chris Ruane: To ask the Secretary of State for the Home Department how many (a) warnings, (b) fixed penalty notices and (c) prosecutions there have been for breaches of Fireworks Act 2003 provisions governing use and sale of fireworks in each police authority area, grouped by region. [203397] Ms Blears: [holding answer 8 December 2004]: The latest provisional data in the following table shows that, from 1 October 2003 to 31 October 2004, 314 penalty notices for disorder have been issued and notified to the Home Office by police forces in England and Wales for offences involving fireworks. These include throwing fireworks, breaches of fireworks curfews and the illegal possession of certain categories of fireworks. These are shown by region and police force area in the table. Data from the Home Office Court Proceedings Database on defendants cautioned (including reprimands and final warnings for juveniles) and proceeded against for firework offences, England and Wales 2003, are also shown in the table. Statistics on cautions and court proceedings for 2004 will be available in autumn 2005. Mr. Dominic Grieve: To ask the Solicitor-General (1) what assessment she has made of the impact that the involvement of the Crown Prosecution Service in the decision on whether or not to charge a person with an offence has had on the number of charges brought; and if she will make a statement; [199148] (2) what assessment she has made of the impact on the number of cases listed at magistrates' courts for a first hearing resulting from Crown Prosecution Service involvement in the pre-charging process at police stations. [199149] The Solicitor-General: Crown Prosecution Service records indicate a gradual increase in the number and the proportion of decisions to charge a defendant over recent months. In April 2004, the CPS charged 1,436 defendants; 20.9 per cent. of all charging decisions made during the month. By October 2004, this had risen to 20,083 defendants or 54.7 per cent. of all charging decisions. Over the same period, the number of convictions in cases subject to a pre-charge decision has risen from 2,152 in April 2004 to 7,939 in October 2004. The efficiencies gained through CPS involvement in the decision to charge frees up the police to re-direct their efforts to the investigation and detection of more crime. Furthermore, cases in which the pre-charge decision is to take no further action are gradually replaced by cases that proceed to charge. CPS records include no indication of the number of cases listed at the magistrates' courts. However, they do show a rise in the number of guilty pleas entered at a first hearing in cases subject to a pre-charge decision, from 850 in April 2004 to 2,680 in October 2004. The charging initiative aims to increase the number of charged cases which proceed to a conviction by improving the quality of those cases, and increasing capacity by removing the number of cases which have no realistic prospect of conviction.
