The Government supports the growth of the social economy. Across England, there are now more than 85 public service mutuals, up from just nine in 2010. Collectively they deliver well over £1 billion in public services.
Cabinet Office analysis from 2013 based on the BIS Small Business Survey estimated that 28% (c. 50,000) of SME social enterprises provide goods or services in the public sector.

I refer the hon. Member to my speech in the Adjournment debate of 13 May 2013, Official Report, column 470 onwards which sets out my position on mutuals very clearly. I am supportive of fire and rescue authorities looking at new and innovative ways of delivering their services to best meet the needs of their communities.

The Government is supportive of fire and rescue authorities considering new and innovative ways of delivering their services more efficiently and effectively, including locally-led mutuals.
However, the Secretary of State for Communities and Local Government, my right hon. Friend the Member for Brentwood and Ongar (Mr Pickles), and I have been very clear that we will make no moves to progress mutualisation that would lead to privatisation.

Supporting the creation and growth of public service mutuals is Government policy, so my Department continues to work with other Departments to explore options for this in a variety of public services, including fire and rescue. As was the case under previous Administrations details of internal discussions are not normally disclosed.

Mutuals continue to drive real change in our public services, helping to boost public sector productivity that had flat lined between 1997 from 2010. In recent months I have personally engaged at the European level to open up restrictive procurement rules, and met with many of the front-line staff taking control of their own services.

I thank the Secretary of State for that reply. Will he reassure me that, while we have examples of good practice in local probation trusts and individuals who want to transfer to a mutual status, those moves will not be opposed by the Ministry of Justice but, rather, facilitated?

I can absolutely give my hon. Friend that assurance. Indeed, we held in this House a week ago, while we were all waiting for the Europe votes, a forum with potential bidders. It was gratifying to see among those in attendance a large contingent from the potential mutual bidders. I am very keen to see them make good progress in this process.

My Noble Friend, Lord Newby, has written to the Noble Lord, Lord Eatwell, to provide further information on a number of points that were raised during the second day of debate on the Financial Services (Banking Reform) Bill in Lords Committee, including a clarification on the point raised by the Noble Lady. A copy of the letter will be laid in the library of both Houses.
The Co-operative Bank is a company limited by shares, and is not itself a mutual. However, the Noble Lord’s letter clarifies that, at present, the Co-op Bank is wholly owned by the Co-operative Group, whose holding company is an Industrial and Provident Society - it is for this reason that it is sometimes referred to as a mutually-owned bank.

it was recommended that the Government, led by the Cabinet Office, should continue to negotiate for greater clarity on and improvements to EU public procurement rules that support newly-formed public service mutuals and clarity on existing rules. In particular the Cabinet Office should press for a temporary exclusion for mutuals; to enable them to be established before being subject to full and open competition.
