To ask the Secretary of State for Education, what assessment his Department has made of the adequacy of enforcement of safer sleep standards across early years settings.
The Early Years Foundation Stage (EYFS) statutory framework sets the standards and requirements early years providers must meet to ensure that children have the best start in life and are kept healthy and safe. The statutory guidance is available at: https://www.gov.uk/government/publications/early-years-foundation-stage-framework--2.
All early years providers are already required to meet the safer sleep requirements set out in the EYFS statutory framework, available at: https://www.nhs.uk/baby/caring-for-a-newborn/sudden-infant-death-syndrome-sids/.
Ofsted is responsible for inspecting registered early years providers against the EYFS requirements and can take regulatory action where providers fail to meet them.
The department continually reviews safeguarding requirements to ensure children are kept as safe as possible. We are planning to update the wording in the EYFS framework so that the safer sleep requirements are set out directly in the statutory framework, rather than through a link to NHS safer sleep guidance, from September 2026, subject to parliamentary and legislative process.
Ofsted has also announced it will inspect safer sleep practice at every early years inspection. This sits alongside additional investment to strengthen inspection and regulatory activity, including funding to deliver an additional 3,000 unannounced inspections each year, helping to strengthen oversight of compliance with safer sleep requirements.

The Government recognises the importance of clear, evidence-based advice on safer sleep for babies and ensuring that baby sleep products placed on the market are safe.
The Early Years Foundation Stage (EYFS) statutory framework sets the standards and requirements all early years providers must meet to ensure that children have the best start in life and are kept healthy and safe.
For parents and carers, we promote evidence-based advice on safer sleep from the National Health Service and trusted organisations such as The Lullaby Trust.
Under United Kingdom law, businesses are responsible for only placing safe baby sleep products on the market, and must provide all necessary information, warnings, and instructions to ensure they can be used safely and appropriately. The product regulator, the Office for Product Safety and Standards, has previously issued a Safety Alert for certain dangerous baby sleep pillows and published messaging to raise consumer awareness of hazards.

To ask the Secretary of State for Business and Trade, what steps his Department are taking to hold companies to account who make sleep products for babies that cause potential hazards.
Under UK law, businesses are responsible for placing safe baby sleep products on the market, including where sold online. The Office for Product Safety and Standards (OPSS) carries out market surveillance and has powers to require unsafe products be withdrawn from sale, and can seek prosecution or fines where businesses fail to act.
Targeted OPSS testing of baby sleep products in 2025 identified non-compliant or unsafe items online, and OPSS acted to ensure platforms removed listings and identified problem sellers. OPSS previously issued a Safety Alert for dangerous baby sleep pillows and published messaging to raise consumer awareness of hazards.

To ask the Secretary of State for Housing, Communities and Local Government, what steps her Department is taking to promote safe sleeping practices in all forms of temporary accommodation where infants are placed.
The All-Party Parliamentary Group for Households in Temporary Accommodation’s report into child mortality found that between April 2019 – March 2025, 104 children have died with temporary accommodation indicated as a contributing factor to their vulnerability, ill-health or death. It is unacceptable that temporary accommodation is contributing to the tragic deaths of children. The Child Poverty Strategy and our National Plan to End Homelessness set out the government’s commitments to tackle unsuitable or poor-quality accommodation and ensure children in temporary accommodation do not experience gaps in health care provision.
These include our commitment to eliminating the unlawful use of Bed & Breakfast accommodation for families by the end of this Parliament as well as working with the Department for Health and Social Care through the Inter-Ministerial Groups on Child Poverty and Homelessness to introduce a clinical code to improve data and prevent incidents in temporary accommodation, ending the practice of discharging newborns into B&B or other unsuitable shared accommodation, and providing proactive outreach to families in temporary accommodation.
Following the success of our £10.5 million Emergency Accommodation Reduction Pilots, with local authorities with the highest use of B&B accommodation, we will expand our work to drive place-based good practice through an Emergency Accommodation Reduction Programme, backed by £30 million over three years.
The government is also providing £950 million of investment for the fourth round of the Local Authority Housing Fund – the largest investment in the fund to date - to support local authorities in England to increase the supply of good quality temporary accommodation and drive down the use of unsuitable B&B and hotels.
Chapter 17 of the Homelessness Code of Guidance provides detailed guidance on suitability of temporary accommodation. It sets out that temporary accommodation will not be suitable for a household with children under the age of 2 if there is not adequate space for a cot for each child aged under 2. It also sets out that housing authorities should consider what support is available for the provision of a cot when a household do not have access to one. You can read the Code of Guidance here.
Alongside this, the Children’s Wellbeing and Schools Act will provide the strongest protections in a generation, making sure vulnerable children are identified and supported. We are also introducing a new temporary accommodation notification duty, to inform schools and specified health providers when a child is placed in temporary accommodation, to allow additional or different support to be provided to these children.
