HM Revenue & Customs (HMRC) is responsible for the collection and publication of data on imports and exports of goods to and from the UK. HMRC releases imports and exports information monthly, as an Accredited Official Statistic called the Overseas Trade in Goods Statistics (OTS), which is available via their dedicated website (www.uktradeinfo.com).
From this website, it is possible to build your own data tables based upon bespoke search criteria. To use the tables, you will need the commodity codes for crayfish, lobster and fish products. These codes are publicly available from the UK Trade Tariff at https://www.gov.uk/trade-tariff. Lobster and crayfish are classified to Chapter 03 of the Tariff and fish products are classified within Chapter 16.
The data on the website will, within limitations, tell you the total value of imports of these products into the UK. It includes value and weight (kg) of imports and exports. However, it will not identify individual items as this could identify individual importers or exporters. This would be in conflict with Section 18 of the Commissioners for Revenue and Customs Act 2005 (CRCA). CRCA restricts the information that HMRC may disclose publicly on persons making imports and exports.
It will not be possible to distinguish imports and exports specifically from or to Tristan Da Cunha because for trade statistics purposes the territory of “Tristan Da Cunha” is included and grouped together with imports from and exports to Saint Helena, Tristan Da Cunha and other islands in this area.

To ask the Secretary of State for Environment, Food and Rural Affairs, if her Department will make an assessment of the potential merits of designating Cornish lobster as a protected product under the Protected Geographical Indication framework.
The Protected Geographical Indication (PGI) framework plays a vital role in championing food and drink products that are regionally distinct and nationally important, helping to preserve heritage, support rural economies, and promote high-quality British produce. A number of celebrated Cornish foods are already protected - Fal Oyster PDO, Cornish Sardines PGI, Cornish Clotted Cream PDO, Cornish Pasty PGI and Darnibole wine PDO.
The designation process is producer-led. As with any prospective name, the Department would welcome an application to protect “Cornish Lobster”. The application would need to give evidence of widespread agreement amongst the lobster fishing fleet of its reputation, exactly what it is, how it is produced or caught and where it comes from. Should producers wish to pursue this, we will carefully consider their case in line with the established criteria under the UK GI schemes.

Animal welfare legislation protects all animals from being transported in a way likely to cause injury or suffering. Lobsters and other live decapod crustaceans are protected from injury or unnecessary suffering during transportation by a general duty of care provision in Article 4 of The Welfare of Animals (Transport) (England) Order 2006 (WATEO) and equivalent national legislation in Wales. WATEO requires that animals are transported in receptacles or means of transport under conditions (in particular with regard to space, ventilation, temperature and security) and with such supply of liquid and oxygen, as are appropriate for the species concerned.

Consideration of the species to be protected under the Wildlife and Countryside Act 1981 is subject to a quinquennial review process by which Schedule 5 and Schedule 8 (listing protected animals and plants respectively) of the Act are reviewed by the British Statutory Nature Conservation Bodies; as set out under the requirements of Section 24 of that Act. This is the process by which Spiny Lobster would be assessed for addition to Schedule 5 of the Act.

We are considering carefully the implications of recognising in law the sentience of decapod crustaceans and cephalopod molluscs. The Government currently has no plans to bring forward legislative proposals to introduce a ban on the sale of live crabs and lobsters online.

Of course they should, because in the white fish sector and the quota sector we have secured an uplift in quota that is front-loaded; the uplift is 15% next year. We will also have full regulatory autonomy on technical conservation measures, which gives us the ability to support the shellfish sector far better than we were able to in the European Union.

My Lords, I thank the Minister, because I had never heard of this 1999 treaty before. It is quite important because we are in the ratification process of a UK-Faroes fisheries agreement. I will raise one or two things about this which perhaps the Minister can explain to me.
