Mr. Cash: To ask the Minister of Agriculture, Fisheries and Food if he will make a statement on the powers which he is using in order to halt the spread of foot and mouth disease; which powers derive (a) from EU legislation and (b) from domestic law, with special reference to (i) slaughter, (ii) disposal of carcases, (iii) movement of livestock (A) without and (B) with transport, (iv) compensation, (v) diagnosis and veterinary inspection, (vi) quarantine arrangements, (vii) limiting access to specified areas, (viii) use of animal byproducts not for human consumption, (ix) health and safety and (x) use of the armed services. [156120] Ms Quin: I refer the hon. Member to the answer given by the Prime Minister on 4 April 2001, Official Report, column 200W. The following points are in addition to that answer. The exercise of domestic powers under the Animal Health Act and Foot-and-Mouth Disease Order is in accordance with the requirements of Council Directive 85/511/EEC introducing community measures for the control of foot and mouth disease (as amended). The carcases of animals killed for disease control purposes are disposed of in accordance with the Animal By-Products Order 1990, which implements Council Directive 90/667/EEC. By-products from animals slaughtered for human consumption are used or disposed of in accordance with the Animal By-Products Order 1999, the Specified Risk Material Regulations 1997, the Specified Risk Material Order 1997 or the Foot and Mouth Disease Order 1983. Powers to ensure the health and safety of workers acting to control the Foot and Mouth outbreak are provided by the Health and Safety at Work Act 1974 (as amended) and COSHH Regulations. The use of the armed forces is authorised by existing domestic powers under the Emergency Powers Act 1964.
