Mrs. May: To ask the Secretary of State for Education and Employment if he will make a statement on the criteria used to determine
whether a decision by a headmaster to exclude a pupil should be overridden. [158852]
Jacqui Smith: Permanent exclusions must be reviewed by the governing body of a school through its discipline committee. Where a
parent or pupil appeals against permanent exclusion, an independent appeal panel will consider the case.
My right hon. Friend the Secretary of State's guidance to appeal panels is that they should decide whether the pupil did what they
are accused of doing, and if so whether, considering all relevant factors, permanent exclusion is a reasonable response to that
conduct. He has advised that reinstatement would not normally be appropriate where the circumstances involve: serious actual or
threatened violence against another pupil or a member of staff; or sexual abuse; or presenting a significant risk to the health and
safety of other pupils by selling illegal drugs; or persistent and malicious disruptive behaviour--including open defiance or
refusal to conform with agreed school policies on for example, discipline or dress code.

A number of PRUs have amalgamated to rationalise and improve the quality of provision following Ofsted concerns about standards in
PRUs in 1995. Ofsted now reports that pupils in most PRUs are making satisfactory or better progress and teaching in 90 per cent. of
units is at least satisfactory. Almost all PRUs now improve pupils' behaviour and attitudes to learning.
A net total of 13 new PRUs have opened in the last year. Since 1997 the number of pupil places at PRUs has risen by over 1,000 and
the number of teaching and support staff is up by nearly 600. The pupil:teacher ratio is 4.3 the same as in 1997. Local authorities
were planning to spend 13 per cent. more on PRU provision in 2000-01 compared to the previous year. This reflects the tenfold
increase in funding to tackle poor behaviour in schools and provide education outside school for those who are excluded, up from £17
million in 1996-97 to £174 million this year.

Mr. Coaker: To ask the Secretary of State for Education and Employment what discussions he has had with teacher representatives
about the establishment of learning support units and pupil referral units. [147925]
Jacqui Smith: We discuss such issues regularly as we meet representatives of the teacher associations about discipline and other
issues. We are providing £174 million from April to tackle truancy, improve discipline and educate excluded pupils. Schools have
welcomed the increased provision and the fact that there are 1,000 more places in PRUs for excluded pupils than in 1997, as well as
plans for over 1,000 in-school units by 2002.
However, it is for local education authorities and the senior management teams of schools between them to decide where best to
establish Learning Support Units to meet identified needs. Before opening or closing a Pupil Referral Unit, local education
authorities should consult locally, including other Pupil Referral Units and their management committees, which may include
headteachers.

Mr. Barry Jones: To ask the Secretary of State for Education and Employment if he will make a statement on the Excellence in Cities
programme. [148534]
Ms Estelle Morris: Excellence in Cities (EiC) addresses the educational problems of our major cities. It provides new opportunities
for gifted and talented children; learning mentors to tackle barriers to learning; learning support units to take disruptive pupils
out of the classroom; city learning centres; small education action zones; and more beacon and specialist schools.
The programme has been running just over a year in the first 25 local education authorities. By September this year, there will be
58 authorities in the programme covering close to a third of all secondary pupils aged 11 to 16. We will also be introducing
excellence clusters in seven areas from September which will pilot the EiC approach in areas of deprivation beyond the big cities--
such as rural areas and coastal towns.
Excellence in Cities is already making a real difference. Last year, in the first EiC areas, the percentage of pupils getting five
good GSCEs or their equivalent increased by nearly twice as much as it did in other areas. The biggest increases were in the most
deprived schools where over half the pupils are entitled to free school meals. In those same areas the numbers of pupils leaving
schools with no qualifications fell twice as fast as elsewhere.
Finally, Excellence in Cities has provided dramatic examples of reductions in exclusions. The whole programme has been widely
welcomed by schools and teachers.
All this underpins our commitment to a programme which when fully implemented will account for over £300 million a year, and will
change both the perception and reality of our city schools. A detailed account of the first year of the EiC programme is contained
in our publication "Excellence in Cities Report: March 1999 to September 2000" (a copy of which is in the House of Commons Library).

Ms Estelle Morris: The latest available data on permanent exclusions are shown in the following table. Data on permanent exclusions
in the school year 1999-2000 will be collected in January 2001 and published in May 2001 (provisional date). Further information on
permanent exclusions was published in the Statistical Bulletin "Permanent Exclusions from Maintained Schools in England" on 29
November 2000, copies of which are available from the Library, or alternatively can be accessed from the Department for Education
and Employment statistical website www.dfee.gov.uk/statistics.
We are providing £174 million this year to help schools and LEAs tackle exclusion--a third more than in 1999-2000 and 10 times more
than in 1996-97. This is helping to pay for more than 1,000 on-site Learning Support Units which take disruptive pupils out of the
classroom quickly, improve their behaviour and reduce the need for exclusion. Where an exclusion is necessary, provision for
excluded pupils is being greatly increased. There are now 1,000 more places and 250 more teachers in Pupil Referral Units (PRUs)
than in 1997. The quality of PRUs is improving and by 2002 all local education authorities will be required to provide a full
timetable for excluded pupils.

The available information is to be placed in the House of Commons Library: proportion of pupils of compulsory school age in
maintained special schools, proportion of pupils of compulsory school age receiving special education in independent schools,
proportion of pupils of compulsory school age receiving special education in non-maintained special schools and the proportion of
pupils of compulsory school age not on the roll of a school or pupil referral unit.
Section 19 of the Education Act 1996 places a responsibility on local education authorities to provide suitable education outside
school for children unable to attend school because of illness, exclusion from school or otherwise. By 2002 provision for pupils
excluded from school must be full-time.
Statutory guidance from the DfEE advises local education authorities to set up systems for collecting data on the number of children
of all ages who are out of school, and their achievements. Such a register will help authorities ensure that vulnerable groups do
not become lost in the system between education and employment.
Information is collected on the number of pupils with special educational needs in mainstream schools.
This is published in the Statistical First Release "Special Educational Needs in England--January 2000" in November 2000. A copy of
this publication is available from the Library and can also be accessed on the Department's statistical website
www.dfee.gov.uk/statistics. However, this does not specifically distinguish between forms of special provision in mainstream
schools.
We do not collect information about those pupils receiving special education in another local education authority. However, we have
included in the table information about pupils receiving education in non- maintained special schools (including hospital special).
