To ask the Secretary of State for Housing, Communities and Local Government, what guidance his Department provides to developers on the level of information required to satisfy Gateway 2 approval for an application to the Building Safety Regulator.
The Building Safety Regulator’s (BSR) handling time for each application is dependent on a range of factors, primarily the quality of the application and the additional information submitted by the applicant. As can be seen in the table below, the average handling time by hour varies.

Information on the length of documents submitted as part of applications is not something the BSR actively collects data for. The length and number of documents required to support a GW2 application varies, and there is no correlation between page length and achievement of a GW2 determination as the size and complexity of projects varies considerably.
The BSR is actively supporting the Construction Leadership Council to develop and publish a further suite of industry guidance on the statutory documents accompanying building control approval applications, staged approvals for single tower HRBs and construction phase and gateway three (completion certificate stage). This is expected in November.

Regulation 3 of the Re-use of Public Sector Information Regulations 2015 defines the public sector bodies to which the Regulations apply, and neither Returning Officers nor Electoral Registration Officers are defined as public sector bodies for these purposes. Consequently, the public are not able to request data held by either Returning Officers or Electoral Registration Officers via these Regulations.

The Re-Use of Public Sector Information (RPSI) Regulations 2015 apply to public sector bodies in the UK, including local authorities. The ICO has produced guidance on the RPSI, which can be accessed on its website and includes details about the scope of the legislation. The National Archives also has detailed guidance available on its website.
The ICO does not have specific plans to update this guidance.

The Electoral Commission produces guidance on the roles and responsibilities of Returning Officers and Electoral Registration Officers in carrying out the statutory functions to deliver well-run electoral services.
The Information Commissioner's Office is responsible for enforcing data protection legislation and has produced guidance for publice sector bodies covered by the Re-Use Public Sector Information Regulations 2015 (RPSI)

The Electoral Commission provides guidance to Returning Officers and Electoral Registration Officers, and recommends that they disclose requested information where possible, provided the information is either already in the public domain or does not include personal data.
