Further to the points made by the Labour Front Bencher, it is just over two years since nearly 800 P&O workers were summarily sacked and thrown off ferries. We will finally debate the Government’s utterly supine and ineffective fire-and-rehire code of practice next week, but it is just over two months since the Government claimed that they were making substantial progress on implementing the nine-point plan for seafarer protections. The Seafarers’ Wages Act still has not come into force, alongside a toothless and voluntary seafarers’ charter, which will not change how P&O operates, even if it signs up to it. We all know that in this House, so is it not time that the Government took meaningful action and got behind our seafarers?

The Seafarers’ Wages Act still has not come into force, alongside a toothless and voluntary seafarers’ charter, which will not change how P&O operates, even if it signs up to it. We all know that in this House, so is it not time that the Government took meaningful action and got behind our seafarers?
The Seafarers’ Wages Act will come into force this summer. Unfortunately, it takes time to pass legislation, and we had to consult on it. No one wants it to come into force quicker than I. The claim that the seafarers’ charter will have no impact is completely untrue. The operators will have to abide by the terms of the charter, which will ensure that seafarers earn the minimum wage throughout their engagements, that they get overtime payments of at least 1.25 times the hourly rate, and that they have rosters that ensure that they are not fatigued and safety is not compromised. The Government will monitor the compliance of the operators with that charter.

The Government has made substantial progress on implementing its Nine Point Plan for Seafarer Protections. The UK continues to play a leading global role in improving seafarer welfare.

The Government will consider the International Labour Organisation (ILO) Committee on Freedom of Association’s recommendations and will provide information on these to the ILO Committee of Experts on the Application of Conventions and Recommendations (CEACR) in due course.
The Government remains committed to all ILO Conventions we have ratified, including Convention 87 on the Freedom of Association and Protection of the Right to Organise, and Convention 98 on the Right to Organise and Collective Bargaining.
The Seafarers’ Wages Act remains a real missed opportunity. Let us look at points six to nine of the Government’s nine-point plan:

“Improving the long-term working conditions of seafarers”?
Nope. As the hon. Member for Wythenshawe and Sale East (Mike Kane) asked, where is the seafarers’ charter?

Nope. The figures went down by another 3% last year and are down by 30% since the Tories came to power. Other than the utterly anaemic Seafarers’ Wages Act, what have the Tories ever done for seafarers?

When SNP Members start talking about ferries, we can tell that they think they are on to a good one. It is interesting that they have not raised the subject of motor homes today instead.
Work on the seafarers’ charter continues as we speak, and I will update the House as soon as more information is available.

Ministers meet regularly with stakeholders, including representatives of employers and employees on various employment-related issues, including matters concerning the Employment Rights Act 1996.
Employment Law is a reserved area except in Northern Ireland where it is devolved. BEIS will continue to work with each devolved administration respecting their unique settlements to ensure we build a strong economy across the United Kingdom.

I have monthly meetings with the ACAS Chair, Clare Chapman, and Chief Executive, Susan Clews, that cover both operational and policy matters. ACAS are an important partner for the Department, and provide important insight into workplace issues as we prepare for an Employment Bill.
That this House observes the widespread and growing use of fire and rehire tactics by employers over recent months; condemns the actions of a number of companies in threatening staff with termination if reductions to wages and conditions are not agreed to; notes the widespread legal prohibition on such employment practices in most EU countries, including Ireland; recognises the contents of the Queen’s Speech in which no mention was made of changes to employment law despite the widespread condemnation of fire and rehire by UK Government ministers; deplores the absence of such legislation in the UK Government’s legislative programme; further condemns the Government for not publishing the ACAS report on Fire and Rehire; and calls on the Secretary of State for Business, Energy and Industrial Strategy to announce comprehensive legislation protecting workers' rights and legally prohibiting employers from employing fire and rehire tactics.

BEIS Ministers meet with Acas monthly. These meetings cover a variety of employment matters.
Acas is holding independent and impartial discussions with a range of stakeholders on the use of fire and rehire practices to change contractual terms and conditions. BEIS officials have met regularly with Acas to discuss insights from this work and the circumstances when fire and hire practices are used.

The provision of driver welfare in Operations Stack and Brock is the responsibility of the Kent Resilience Forum. In the event of significant disruption on the M20, the Kent Resilience Forum may take the decision to activate their Driver Welfare Plan, which includes the proportionate distribution of welfare at the roadside. Both the Department and the KRF monitor the situation closely and have the capability to increase the provision of welfare depending on the scale of demand, as demonstrated by the response to the extreme traffic disruption that occurred over the Christmas period as a result of France closing the border.

That this House notes with alarm the growing number of employers, especially in the retail, hospitality and aviation sectors, who are making employees redundant before re-employing them on less-favourable terms and conditions; believes that these employers are cynically using the covid-19 crisis as cover to reduce staff costs at a time when they should instead be focused on supporting their employees through this pandemic; agrees with Unite the union and others that this fire-and-rehire practice makes a mockery of workers’ rights and goes against the spirit, if not the letter, of UK employment legislation; and calls on the Government to close this legal loophole as a matter of urgency, for example by amending the Employment Rights Act 1996 to specify that such redundancies should automatically be regarded as unfair dismissals.

Following on from the question from my hon. Friend the Member for Kilmarnock and Loudoun (Alan Brown), I met Realgrassroots, which explained that it had been campaigning against the exploitation of young footballers since 2010 and that the Scottish Parliament is investigating the issue. Will the sports Minister meet me to discuss it further, and commit to ensuring that football clubs abide by basic employment legislation, the enforcement of which is reserved?
