My Lords, maltreatment of patients in the NHS is totally unacceptable. The Government are determined to tackle this. Patient safety should be at the heart of everything the NHS does. The Care Quality Commission will be conducting unannounced inspections of NHS trusts. We are also seeking to strengthen accountability in the NHS and ensure that patients and their families have a stronger voice.

Is she aware that, over the past five or six years, I have raised in this House scores of cases of patients receiving appalling treatment in our hospitals? Although every case was properly authenticated, no hospital ever took action, no wrong-doings ever stopped, no culpability was ever admitted and no apology was ever made. Will she ensure that cases raised in this House by your Lordships will be acted upon without waiting years and years for an ombudsman’s report to arrive?

My Lords, I am well aware that the noble Baroness has had a remarkable record in raising these cases and she deserves enormous credit for that. Many of these patients have been very vulnerable and often voiceless. The first thing we have to do, therefore, is to ensure that the systems that are in place are working properly. The first duty falls to the individual NHS organisation to investigate such an incident and take action. It is for the Care Quality Commission to intervene where there are serious concerns, but the ombudsman, in her recent report, makes it very clear that we all have a responsibility here, and it must be our responsibility to make sure that patients are treated with care and compassion at every level of the service.

My Lords, is the Minister aware that following the admission of a Mrs Beryl Alice Waters to Queen's Hospital in Burton-upon-Trent on 30 September, her family were informed by a staff nurse Willis that nurses and carers were forbidden to help patients to eat. This information was given in front of a consultant and two other doctors in the course of a ward round, and they in no way denied it. Why are such orders issued?

My Lords, the noble Baroness has been very concerned about this issue, and I agree with her that this can be very distressing indeed for families and carers. As I have already said, there may sometimes be clinical reasons for withholding food and drink from a patient. However, if such a message were ever given other than for clinical reasons, it would certainly not be endorsed by the Department of Health, and local managers would need to investigate and account for it. Ensuring that patients have adequate nourishment is part of the core caring of nursing.

My Lords, unless there are clinical reasons for withholding them, patients are entitled to food and drink of adequate quantity and quality and to help to ensure that they eat and drink. Hospital staff should ensure that a patient's oral nutrition and hydration are being provided in a way that meets the patient's needs, and that any problems, such as difficulty in swallowing, are managed effectively.

My Lords, the NHS has made excellent progress in implementing this important health and safety legislation, which ensures that patients receive safe, high-quality care from staff who have not worked excessive hours. Only doctors in training remain to become fully compliant by 1 August and two-thirds of them are already working a 48-hour week averaged over 26 weeks. Our overriding principles are patient safety and the quality of care. This is paramount to all that we do.

My Lords, has the Minister noted the severe warnings from the president of the Royal College of Surgeons and bodies representing junior and hospital doctors who are far from pleased about the arrangements that have been made so far and who should know what they are talking about? They say that this diktat will mean surgeons not being properly trained, patient safety being severely compromised and hospitals closing. Does the Minister really think that the problem should continue to be met by junior hospital doctors being ordered by their NHS bosses to lie about the hours they work in order to keep to the restrictions? Why cannot the Government simply refuse to accept these rules or ignore them as other countries do?

My Lords, I am aware of these debates and refer to a publication from the Institute of Medicine in the US, which is the US academy. It stated that the surgery profession was concerned about the shift in work mentality, loss of professionalism and decreased access to quality surgical care; but that it was difficult to assess how much of the complaining represented rhetoric and resistance to change rather than valid criticism.
I am here to share evidence with noble Lords. The evidence is quite clear from the Institute of Medicine’s publication—the error is human. In 1999, between 44,000 and 98,000 people died in hospitals from adverse effects. The single and most important contributor is sleep deprivation and fatigue. The reduction to 48 hours a week is to enhance patient safety and, let us not forget, to enhance the social well-being of doctors, who have the highest rates of divorce, addiction and depression.

My Lords, perhaps I may be the first to offer warm congratulations to the noble Baroness on the assumption of her new job. I hope that she enjoys great success and derives much satisfaction from it. However, is she as concerned as I am at the recent report that 140,000 patients recently discharged from NHS hospitals were found to be suffering from malnutrition? Although some of them may have been so suffering when they went in, her own department has shown that 8,500 were in a state of starvation when they came out. The Health Minister in the other place has admitted that starvation in our hospitals is really quite common. Will the noble Baroness please see that some urgency is injected into this very important matter, on which I have been pressing this House for many years?

My Lords, the noble Baroness has an admirable track record of campaigning on these issues and I thank her for drawing them to the attention of the House again. We know that some patients are admitted at risk of malnutrition. Often this is part of their clinical condition, especially where illness causes a loss of appetite and where there is malabsorption. It is important that staff recognise patients at risk and take the necessary steps to help improve their nutritional state. The noble Baroness is quite correct about that. Indeed, recognising and recording patients with a diagnosis of malnutrition is an essential first step to solving the problem. This is and has to be a priority, and it is a priority in the Nutritional Action Plan. The work of the National Patient Safety Agency is undertaken to build nutrition screening into all treatment plans as a proactive means of avoiding the risk of malnutrition.

My Lords, nutrition is important for all patients. In October 2007, we published Improving Nutritional Care: A Joint Action Plan to outline how nutritional care and hydration can be improved in NHS hospitals. We have introduced protected mealtimes and focused on nutritional screening.

For two and a half years, a family friend has been going in and out of hospital and has never yet been in a ward that was not mixed. She has never been married and has never shared a bedroom with a man. For her, it is acutely painful. Does the Minister accept that the figures that he gave earlier about the diminution in the number of mixed wards can be given because many wards have been reclassified as a different kind of ward or as not being a ward at all? How can the situation go on, with more and more evidence of increasing numbers of people going into mixed-sex wards, if that is not the case?

My Lords, the work that has been done under this Government has been to build more hospitals with single rooms. There have always been some wards with multiple bays, and they are treated as mixed wards in view of not having mixed sleeping accommodation. I understand the noble Baroness’s concerns about her friend. However, I should like to quote the guidance given to the NHS: "““There are circumstances when admission to mixed-sex accommodation is unavoidable. However, those occasions should be exceptional and patients admitted as an emergency should be moved to acceptable accommodation at the earliest opportunity””."
I fully support that guidance, which was provided by a Conservative Government.
