While the Secretary of State is absolutely right to say that it is far too soon to judge the impact of the Licensing Act on binge drinking, does she nevertheless agree that one impact has been to create a bureaucratic nightmare for many people? Only today we have heard reports that up to one in six public houses may be trading illegally because they are still awaiting the licence for their premises.
The Secretary of State has just told us, on village halls, amateur sports clubs and so on, that the Government are to consider the matters raised earlier and report on them later. Yet only today I have discovered that the carrying out of the initial part of the Elton report is many months late.
Is the Secretary of State also aware that we have discovered today that the Government are miles behind in their work and consultation on temporary events notices? What is she going to do about that?

With great respect to the hon. Gentleman, that is the kind of diatribe I have come to expect of him. I do not accept all his charges. I am extremely circumspect about making any prediction at this stage on the impact of the Licensing Act, but it will be judged in terms of the objectives set out within it: does it reduce alcohol-related crime and disorder; and does it protect the vulnerable and keep children safe from harm? Those are the tests against which the Act will be judged, and the House will be able in due course to pass its own judgment.

Since the Licensing Act 2003 (Consequential Amendments) Order 2005 came into force on 24 November 2005, no specific guidance has been published by the Department on this matter. However, my officials have taken steps to alert the trade to the possible use of Temporary Event Notices (TENs) where these can assist with particular needs.

In answer to the hon. Member for West Lancashire (Rosie Cooper), the Minister told the House that the views of local residents and councils were taken into account in deciding the new licences, but that is simply not true. Only today, a leading local government organisation said:"““thousands of applications have gone through against the will of the licensing body””."
Will the Minister assure us that the views of local residents and councils will be taken into account during the review? Will he also assure us that local people and councils who request a non-vexatious review will not be financially penalised for so doing?

I can give the hon. Gentleman that guarantee on his final point. If he contacts LACORS—Local Authorities Co-ordinators of Regulatory Services—the organisation to which I think that statement was attributed, he will find that it is putting out a statement that makes it clear that that is not its view. In two thirds of cases, applications have been resolved through negotiation and the process is about devolving powers to the local level. We are happy to work with all parties in the House to ensure that local authorities have all the powers that they need, but this is local democracy in action, and not the opposite of that.

[holding answer 24 October 2005]: A number of measures are being drawn upon to assess the impact of the Licensing Act on levels of crime and disorder in England and Wales.These include the use of national surveys including (but not limited to) data on alcohol related crime from the British Crime Survey. These national measures will be supplemented by local area case studies in five police force areas in England. These local case studies will look at patterns of recorded crime and disorder in relation to licensed premises and extended hours. This work will also include surveys of local residents and a range of businesses, including licensees, that may potentially be affected. The work will establish a baseline against which any change can subsequently be measured.It is intended to supplement this exercise in the five areas with information from ambulance call-out statistics and accident and emergency departments, and the Home Office are currently engaged in discussion with the Department of Health on the feasibility of this issue. The Home Office are leading on this work, in consultation with other Government Departments including the Departments of Health, and Culture Media and Sport.

We already know that judges, doctors, many senior police officers, officials in the drink industry and the public at large are deeply concerned about the negative impact of the Licensing Act; but what about the Minister himself? When he was personally involved in drafting for the Labour party that infamous text message"““cldn't give a XXXX 4 last ordrs? vote Labour 4 xtra time””,"
did he imagine that, shortly before the 2001 general election, that message would give the impression that under Labour there would be a crackdown on binge drinking, or the impression that under Labour young people would have more time to get drunk?

I have great respect for the hon. Gentleman, but he should know better than to believe everything that he reads in TheMail On Sunday. I can clarify that that report was total fantasy and that I had absolutely nothing to do with it. I was not working in Millbank; I was campaigning in Stalybridge and Hyde. As the Secretary of State has made clear, we regret that text message, but it had nothing to do with me.

In Singapore, I had the opportunity of congratulating the Olympic bid team on its great success. May I take this opportunity, on behalf of all my hon. and right hon. Friends, to reiterate those congratulations?
Turning to licensing, does the Minister accept that one of the last-minute agreements to provide a bulwark for local communities against unwanted late-night drinking was the idea of the special saturation policy? Is he aware that there is such concern about the legal minefield that was created by the guidance on the policy that only a quarter of local councils have taken the opportunity to use it? Will he at least make a commitment today to work with his colleagues in the Home Office to use any legislative opportunity that might avail itself to improve the legal back-up of the policy?

We are working on the Violent Crime Reduction Bill to introduce a range of measures to reinforce the powers to deal with such problems, but I do not think that there is a problem with the framework of the law. We are bringing in a new piece of legislation and devolving power to local authorities, so it is up to them to decide how to implement the law. The hon. Gentleman will recognise it as welcome that, if local authorities are worried about saturation, for the first time, they will be able to turn down applications. Under the current law, they have no opportunity to do so and must grant licences even if there is an excess of booze factories, as they are called, in an area. The Act is a better piece of legislation and when people look at it in one or two years' time, they will probably agree with that.

Mr. Don Foster: To ask the Secretary of State for Culture, Media and Sport what her estimate is of the date for the first appointed
day, as specified in the Licensing Act 2003; and if she will make a statement. [171396]
Mr. Caborn: The timetable for the first appointed day, when licensing authorities will be able to accept applications for the
conversion of existing licences and club registration certificates, will be dependent on the date when, or if, Parliament approves
the draft Guidance made under section 182 of the Act which has been laid before it.
Parliament will not be able to consider the draft Guidance until the Joint Committee on Statutory Instruments have completed their
scrutiny of it and reported to the Houses. We expect the first appointed day to be six months later than the date of Parliamentary
approval. The timetable we hope for would see approval by Parliament at the end of this month which would therefore lead to a first
appointed day in November.

Mr. Don Foster: To ask the Secretary of State for Culture, Media and Sport what estimate she has made of the administrative costs to
(a) local authorities, (b) individual licensees and (c) central government of the changes to the licensing
regime resulting from the Licensing Act 2002; and if she will make a statement. [154061]
Mr. Caborn: Proposed fee levels and the expected costs of compliance with the 2003 Act were set out in the Regulatory Impact
Assessment which accompanied the Licensing Bill and is available from the House Library. Regulations setting out the fees to
accompany applications for licences, club premises certificates and other applications will be laid before Parliament shortly,
showing the cost to individual licensees and applicants.
The Department is working closely with the Local Government Association to produce licensing fees which are set at a level to
provide for full cost recovery in respect of administration, inspection and enforcement. In those cases where the Department has
announced that there will be an exemption from the payment of fees in certain circumstances the costs will be met by central
government.
