Mrs. Dunwoody: To ask the Secretary of State for Health where diagnostic and treatment centres (DTCs) will be located; what the status will be of NHS consultants employed on a sessional basis by DTCs; what formal arrangements will be concluded for after- care; and what the budget for DTCs will be. [119486] Mr. Hutton: A list of the locations of the 46 national health service-run diagnosis and treatment centres (DTCs) open or in development is shown in the table. The location of the independent DTC chain units, for which a procurement process is currently underway, will depend on the response of the independent sector to the clinical requirements of the NHS and the value for money for NHS commissioners offered by the different solutions. _________________________________________________________________________________________________. The status of NHS consultants employed on a sessional basis by NHS DTCs will depend on local circumstances. Where consultants work in an NHS DTC as part of their contract with an NHS trust, their current terms and conditions of service will apply. But alternative arrangements can be agreed locally. Independent sector DTC providers will take clinical and managerial responsibility for any work carried out by NHS staff in their units. For both NHS and independent sector DTCs, arrangements for aftercare will be agreed locally between NHS commissioners and the providers concerned. £350 million capital has been invested in NHS DTCs. The cost of services delivered by NHS DTCs is for local agreement between the NHS provider and local NHS commissioners. The cost of services delivered through independent sector DTCs will be determined as part of the current procurement exercise.

Mrs. Dunwoody: To ask the Secretary of State for Health if he will list the terms and conditions under which diagnostic and treatment centres (DTCs) will provide non-urgent surgery to the NHS; how many non- NHS units and companies have been asked to tender; what the (a) nationality and (b) company HQ address is of the non-NHS companies on the list; what terms and conditions will be applicable to non-NHS staff working in DTCs; and what legal protection will be offered to patients receiving treatment outside the NHS from private DTCs. [115174] Mr. Hutton: There will be national health service run and independent sector-run diagnosis and treatment centres (DTCs) providing non-urgent surgery to NHS patients. NHS-run DTCs will be part of NHS trusts and will be subject to NHS governance and standards; independent sector DTCs will be expected to meet independent sector standards and will be regulated and inspected by the National Care Standards Commission. The intention is that the contracts for independent sector DTCs will be based on a standard project agreement containing a common core set of terms and conditions reflecting this. 15 companies have been short-listed and their details can be found at: http:// www.doh.gov.uk/growingcapacity/news.htm This will be updated with further information on a regular basis. To comply with employment and health and safety legislation, guidance on pre and post-employment checks and all clinical staff will need to be registered with the appropriate regulatory body and properly trained and competent to carry out the roles required of them. Patients treated at NHS expense in DTCs will remain NHS patients and their rights as NHS patients will not be affected. They will, for example, have a right to use the NHS complaints procedure, and providers will be expected to co-operate with the investigation of complaints under that procedure.

Mrs. Dunwoody: To ask the Secretary of State for Transport how many of the non-fatal injuries that occurred on the rail network required hospital treatment in each year since 1997; and what definitions his Department uses for the different categories of injury incurred by passengers on the rail network. [98589] Mr. Jamieson: The recording of information on injuries occurring on the railway network are a requirement of the Health and Safety Executive's (HSE) Reporting of Injuries, Diseases and Dangerous Occurrences Regulations (RIDDOR), 1995. It is a RIDDOR requirement that HSE is informed of the following injuries: (a) Fatalities; (b) Major injuries to railway employees; (c) Minor injuries to railway employees resulting in an absence from their normal range of work duties for more than three consecutive days; (d) Injuries to members of the public resulting in the injured person being removed from the site of the accident and taken to hospital for treatment. Information provided by the HSE on the numbers in each year since 1997 of non-fatal injuries that occurred on the rail network is shown in the following table: _________________________________________________________________________________________________.
