This information is not collected centrally. Our guidance calls for single sex accommodation, not single sex wards. Good segregation can be achieved where men and women are cared for in single sex bays or rooms within the same ward.

The National Health Service Confidentiality Code of Practice, published in November 2003, provides guidance on required practice for those who work within or under contract to NHS organisations about the safeguarding of confidentiality, and patients’ consent to the use of their health records.The guidance includes an explanation of the main relevant legal requirements, and examples of appropriate information disclosure decisions in practice. The guidance applies equally to clinicians, managers, and all other staff in both primary and secondary care settings whose work involves access to personal information and, where appropriate, includes staff in the private and voluntary sectors.A full version of the code can be downloaded from the Department’s website at www.dh.gov.uk/assetRoot/04/06/92/54/04069254.pdf. The code has been endorsed by the Information Commissioner, the General Medical Council, and the British Medical Association. The code is applicable irrespective of the method by which patient information is supplied to a third party.Strong disincentives exist which protect against abuse of patient confidentiality. NHS organisations are responsible, as employers, for the actions taken on their behalf by their employees, and for disciplining their staff when they behave inappropriately. Accessing personal information without a legitimate reason constitutes a breach of the code. Staff who breach patient confidentiality are subject to professional disciplinary measures. Offending doctors and nurses will be reported to their professional regulatory bodies and may face additional disciplinary action, including losing their licence to practice. Separate legal penalties for individuals and organisations misusing personal health and other information are provided for under section 60 of the Data Protection Act.

The improvement of any existing services and future planning of effective transport links between the University Hospitals of Hartlepool and North Tees are the responsibility of the local national health service working in partnership with the relevant local transport authorities.At my recent meeting with the hon. Member, he agreed to meet with local transport authorities, the local NHS and other stakeholders in order to move forward with ideas on how to promote better access and transport links and we welcome this.

We are not aware of any recent national surveys. The national patient survey programme, which asks patients about their experience of national health service care, does not request this information.

The Department has not issued specific guidance in this area, but the NHS Data Dictionary produced by Connecting for Health uses the definitions given in the United Kingdom Government data standards catalogue to identify individuals by gender.

Additional resources have been included in primary care trust (PCT) allocations to plan and provide for the extension of non-emergency patient transport services.It is important to note however that some PCTs already operate a greater level of eligibility than the current Department guidance requires, and therefore the actual cost may be lower.The draft guidance currently under consultation sets out broad, national eligibility criteria, also allows local PCTs the flexibility to better design services around the need of the patient. PCTs may choose to develop more detailed guidance to aid local implementation.

The Department has not made an assessment of national health services trusts’ compliance with guidance on the hospital travel costs scheme (HTCS). It is for individual trusts to decide how best practice guidance is implemented locally.As part of the ““Our health, our care, our say”” White Paper commitment to expand the HTCS to include referrals by health care professionals, we will be consulting on other issues such as alternative ways to raise awareness of the HTCS.

The Department does not collect figures on how much has been paid out through the hospital travel costs scheme, nor how many patients have benefited from the scheme. It is for primary care trusts, as local commissioners of services, to make provisions so that patients with either a financial or medical need for transport can travel to and from their treatment or care.

I have been asked to reply.Information prescriptions pilots will take place initially in the areas of cancer, mental health and vulnerable older people. The number of people involved has not yet been determined. The initiative has funding of £1.35 million. The cancer pilots are being developed in partnership with Macmillan and Cancerbackup and are expected to begin in December 2006.

Cancer waiting times data is not available for 1997 and 2006 data is not available in the format requested. Cardiac waiting times data is not held centrally.A cancer out-patient waiting time standard of a maximum two weeks from urgent general practitioner referral to first being seen by a specialist was introduced in 2000. The latest quarterly performance data (quarter one, April to June 2006) shows that at Barnet and Chase Farm Hospitals National Health Service Trust 100 per cent. of cancer patients were seen within two weeks of urgent referral by their general practitioner (GP).Cancer treatment standards of two months from urgent GP referral to first cancer treatment and one month from diagnosis to first cancer treatment were introduced at the end of 2005. Latest quarterly performance data shows that 95.1 per cent. of patients were treated within two months of urgent referral by their general practitioner and 100 per cent. of cancer patients were treated within one month of diagnosis at Barnet and Chase Farm Hospitals NHS Trust.

I put it to the Minister that she totally misunderstands the central point made by my hon. Friend the Member for Croydon, Central (Mr. Pelling) and others. We all agree that, at a time of massive change in the NHS, a strong patient voice is required. However, given that LINks will not have the powers that patient forums had to monitor and inspect the NHS and access information, and given that PCTs will be obliged to listen to the recommendations of LINks, but will not necessarily be obliged act on them, is the Minister not at least a little concerned that LINks will turn out to be nothing more than toothless talking shops?

I certainly agree, and I congratulate my hon. Friend on all the work that he does on the all-party group to promote patient and public involvement. Patient forums have done an excellent job and we do not want to lose the expertise that has been built up. I will examine the ways in which we can work with local authorities, which will handle the contracts for the local involvement networks, to ensure that they are able to bring existing members into the new system. However, one advantage of the new system is that LINks will examine not only health services, but social services, so they will be able to consider some of the joint commissioning between the two and work closely with some of the overview and scrutiny committees. Such a system will provide a better overview of access to local services. It will ensure that local services are of a high quality and give people the right to challenge them if they are not.

Friend agree that we need a stronger and more effective system of patient and public involvement than that which we have had thus far? She will have the opportunity to meet forum members from all over the country at a meeting next Monday in the House, which I am sure will be most productive. Does she acknowledge that the transition from the existing system to LINks must be sensitively handled so that we can maintain the involvement of volunteers and continuity, and deal with all the changes and the comments about them that will be required? I am certainly aware of the good PPI work that goes on in the hon. Gentleman’s area. However, when we consulted on the future of patient forums and PPI, many of the forums told us that some of their inspection work was duplicated by the Healthcare Commission. We will want LINks to examine the services provided in a specific area by following the patient pathway, in a sense, rather than by being attached to individual buildings and simply inspecting those. I assure the hon. Gentleman that we will expect the Healthcare Commission to involve LINks when it carries out inspections, but we do not want the duplication of inspection activities that exists at the moment.

Would the Minister be interested to hear about the good work that is taking place between Croydon’s PPI and the Mayday trust? For example, there was an unannounced visit last week to eight wards and recommendations were made on both the quality of fare and patient care. Such lay-visiting puts as its first question, ““Would I like my relative or myself to be in these conditions in the hospital?””, but surely that will not be available under the new and more formalised local involvement networks.

We have made connections between local involvement networks and the possibility of petitions. We have said that local involvement networks can, through the overview and scrutiny committees, approach PCTs and ask for a response within 20 days if there are complaints about a service. LINks will be able to work with PCTs, and can ask them why they have made particular priorities in an area, whether they are adequately assessing local health need, and whether they are prioritising spending to effect any changes needed. They will be able to challenge service delivery and involve a much wider group of people than are currently involved in patient forums.
