To ask His Majesty's Government what safeguards they will retain to ensure national consistency in educational standards following the implementation of plans to reform funding for special educational needs and disabilities provision in mainstream and specialist schools.
We have appointed an independent panel of experts, led by education and health co-chairs, to advise on what approaches, strategies, and tools should be included in the National Inclusion Standards and Specialist Provision Packages.
The Standards will set out the provision that ordinarily should be in every setting across the 0 to 25 system. This is in addition to the evidence-based tools, strategies and approaches for educators to support children and young people with special educational needs and disabilities.
Specialist Provision Packages describe the support available for children and young people with the most complex needs. These measures are designed to create a consistent, high-quality offer, wherever they live, thereby ending the post code lottery of support.
We will develop a national cost framework for these packages, and we expect to engage with stakeholders and consult on any new funding arrangements in due course.

The department has published the ‘Every Child Achieving and Thriving’ Schools White Paper, alongside a special educational needs and disabilities (SEND) consultation, which set out our plans for reform, including those relating to funding. We have also published additional information on SEND Reform for those leading and working in mainstream schools, and a summary of what the SEND reforms mean for specialist provision, including special schools, which are available on GOV.UK.
In taking forward these plans, our aim is both to establish a fair mainstream school funding system that directs funding to where it is needed, enabling improved support for children with SEND, and to create a fair, transparent system that gives specialist schools stable, predictable funding to deliver high-quality education and integrated support for children with the most complex needs. We will consult on proposals for specific funding changes as these plans are further developed.

Specialist Provision Packages (Packages) will set out the provision required to support children and young people with complex needs and will underpin the education entitlements in education, health and care (EHC) plans. Health services are responsible for delivering and funding the health elements specified in an EHC plan.
Through our reforms, we will improve access to multi-agency support in EHC plans, across education, health and care.

The government will develop a national cost framework for specialist provision packages, and we expect local authorities to commission provision based on that framework, whether that is within a specialist base in a mainstream school, or a special school, including those in the independent sector.
We will undertake a period of evidence gathering and stakeholder engagement to ensure that the framework is appropriately supporting high quality provision whilst tackling excessive prices and profit making.

To ask His Majesty's Government what assessment they have made of local authority attempts to introduce banding frameworks for children and young people with special educational needs and disabilities.
Many local authorities have systems which indicate the range of top-up funding that might be provided for children and young people with a particular type and complexity of need, sometimes referred to as ‘banding frameworks’. These can help determine levels of high needs top-up funding for children and young people with special educational needs and disabilities. A system which agrees likely levels of top-up funding in advance can also be an efficient, clear and transparent way of allocating funding.
The department has published guidance on how local authorities should allocate this funding. Section 7.4 of the high needs funding operational guidance sets out that top-up funding can reflect the costs of provision for a cohort of pupils at or within a school or college. The operational guidance is available on GOV.UK.
Funding does not need to be tied to the detailed provision that may be required or which is specified in education, health and care (EHC) plans, since schools and colleges have flexibility in deploying resources.
The local authority must be satisfied, however, that the final allocation of funding (both the top-up funding and other elements of funding) is sufficient to secure suitable provision for example, as outlined in an EHC plan.
