I thank the Minister for her reply, which raised some of the fears that I have on this matter. The considerable sums of money required for education in Northern Ireland are now in deficit. Of the £12.3 million allocated, one third—£4 million—was addressed to the particular directive to the education boards on what I assume to be, and what I think the Minister has confirmed to be, restructuring. Will she ensure that there is full consultation on any such proposals, particularly as they will affect rural communities and schools adversely and disproportionately? Will she further ensure that any proposals are rural policy proofed and in accordance with section 75 of the Human Rights Act 1998?

I am happy to give the hon. Gentleman that assurance. Wherever there are possible school closures or amalgamations, a development proposal has to be produced by the board and must be subject to full consultation before coming to the Minister for approval or otherwise. The issue involves not just small schools, but ensuring quality of education. Rural areas perhaps have different needs than some more urban areas. A number of factors must be taken into account, but I give the hon. Gentleman a categorical assurance of full consultation first.

I expect proposals from managing authorities in relation to reshaping the schools' estate to include a range of measures to ensure that all our schools can provide a high-quality education for all pupils. These proposals might include closure, amalgamation or more innovative solutions where they are educationally and financially viable. I am also expecting proposals by the end of this month for shared services that will release additional resources to the front line and, in particular, the classroom.

Free transport provision is available to pupils who have been unable to gain a place in suitable schools within specific distances of their home i.e. two miles for primary and three miles for secondary age pupils. While there are no plans to change this criterion the Department of Education is currently undertaking a review of the current arrangements.

Diabetes is a medical condition and as such teachers are dependent on medical professionals for identification, diagnosis and support.Once a school has been made aware of a pupil with this condition, the school's medical support team is contacted and medical staff give training for individual teachers, where it is deemed appropriate. Specific advice and guidance on the support required for pupils with type 1 diabetes in schools is dependent on medical advice from a Health and Social Services Trust's community paediatrician which enables provision of support and interventions, as appropriate.In addition the Education and Library Boards and Health and Social Services Trusts circulate advice and guidance to schools on the most common medical conditions e.g. diabetes, epilepsy, asthma.The Department of Education will, in the near future, be issuing guidance to schools on how to support pupils with medical needs.From 1 September 2005, the Special Educational Needs and Disability (Northern Ireland) Order 2005 will be in operation in Northern Ireland. This law will prohibit discrimination on grounds of disability in education and will require schools and general qualifications bodies to make reasonable adjustments to ensure that children and young people with disabilities are not put at a substantial disadvantage compared to those without disabilities. Type 1 diabetes would be considered a disability under this legislation.

My Department issued comprehensive guidance to schools in 2002 on the health and safety of pupils on educational visits. The document contains detailed advice regarding pupils with medical needs, including children with diabetes.The Disability Discrimination Act 1995 does not apply to the provision of education in Northern Ireland. However, from 1 September 2005, the Special Educational Needs and Disability (Northern Ireland) Order 2005 will be in operation in Northern Ireland. This law will prohibit discrimination on grounds of disability in education and will require schools and General Qualifications Bodies to make reasonable adjustments to ensure that children and young people with disabilities are not put at a substantial disadvantage compared to those without disabilities. These duties cover all aspects of school life, including school clubs and trips. Type 1 diabetes would be considered a disability under this legislation.The Departments have tasked the Equality Commission (Northern Ireland) with producing Codes of Practice and other guidance materials to support the disability discrimination aspects of the Order for schools and Further and Higher education institutions.
