Brian White: To ask the Secretary of State for Trade and Industry what statutory investigatory powers the Department has; which ones will be superseded by use of the Regulation of Investigatory Powers Act 2000; and what plans she has for removing these legacy powers. [136122] Jacqui Smith: The Department has wide investigatory powers, principally under the following legislation: Part 14 of the Companies Act 1985 (used to investigate the affairs of companies and related matters); Part 11 of the Financial Services and Markets Act 2000 (used to investigate financial services matters such as insider dealing); the Wireless Telegraphy Act 1949 (used to enforce against the criminal offences of unlicensed use of radio, deliberate interference, hoax calls and the sale, advertising or possession of certain restricted radio apparatus); the Police and Criminal Evidence Act 1984 (used in criminal investigations conducted by the Department to gain access to `special procedure' material under a court order). However, these powers will henceforth be subject to the approved RIPA regime. The Department is a relevant public authority for the purposes of Part 2 (surveillance and covert human intelligence sources) of the Regulation of Investigatory Powers Act 2000 (RIPA) and is intended also to become a designated public authority for the purposes of Chapter 2 of Part 1 (acquisition and disclosure of communications data). RIPA does not amend or replace any of the Department's statutory investigatory powers. However, the Department's existing powers to compel production of information will not be used to compel disclosure of communications data by service providers when (subject to Parliament's approval) Chapter 2 of Part 1 of RIPA is fully in force. The Department's Radiocommunications Agency [`RA'], has investigatory powers under the Wireless Telegraphy Act 1949 and related legislation. However, responsibility for management of civil radio spectrum use will pass to OFCOM on 29th December 2003 under the Communications Act 2003. The position with regard to the exercise of RA's powers is currently the same as the Department's.

Brian White: To ask the Secretary of State for Culture, Media and Sport what statutory investigatory powers the Department has; which ones will be superseded by use of the Regulation of Investigatory Powers Act 2000; and what plans she has for removing these legacy powers. [136129] Mr. Caborn: Under section 10(8) of the Football Spectators Act 1989 it is a condition of every `Licence to Admit Spectators' that the Football Licensing Authority (FLA) be entitled (a) to enter at any reasonable time any premises at which a designated match is being played or is to be played (b) make such inspection of the ground and such inquiries relating to them as necessary and (c) to examine any records relating to the operation of the national football membership scheme on the premises, and take copies of such records. Under section 13 (6) of the Act, any inspector appointed by the Licensing Authority may (a) enter at any reasonable time any premises at which a designated football matches are played (b) make an inspection of the premises and such inquiries relating to the ground as necessary and (c) to examine the safety certificate and any records kept under the Sports Ground Safety Act 1975, or part of that Act, and take copies of such records. Section 43 of the Gaming Act 1968 gives the Inspectors of the Gaming Board of Great Britain the rights to entry to licensed premises and other related rights. In relation to Society Lotteries, Section 12 of Schedule 1A (b) (c) and (d) allows the Gaming Board to inspect and take copies of documents and computer records, information kept "otherwise than in writing" and any aspect of the management of these lotteries. This also applies to powers to deal with the registration of lottery managers under Schedule 2a of the Act. None of these existing powers will be superseded by use of the Regulation of Investigatory Powers Act 2000 and consequently there are no plans to amend or repeal any of these powers.

Brian White: To ask the Secretary of State for Transport what statutory investigatory powers the Department has; which ones will be superseded by use of the Regulation of Investigatory Powers Act 2000; and what plans he has for removing these legacy powers. [136125] Mr. McNulty: The Department for Transport is responsible for the following statutory investigatory powers: Sections 179 and 180 of the Road Traffic Act 1988, 76 and 77 of the Public Passenger Vehicles Act 1981, 129 of the Transport Act 1985 and 128 and 129 of the Road Traffic Regulation Act 1984, to require production of documents and to call witnesses in the course of an inquiry.1 Section 180 of the Road Traffic Act 1988, to inspect a vehicle that has been involved in a road accident. Section 75 of the Civil Aviation Act 1982, to obtain information in connection with investigations of air accidents. Sections 257 to 260, 267 and 268 of the Merchant Shipping Act 1995, to require the production of documents and call witnesses under a formal inquiry, and require production of ships' documents and other documents necessary for inspections and examinations. Section 119 of the Railways Act 1933, to require the production of information to make directions to railway operators about safety. The Department for Transport does not have any statutory investigatory powers that would be superseded by the use of the Regulation of Investigatory Powers Act 2000 or plans to amend or repeal any of its powers to that end. The above powers will continue to be used to compel the necessary and proportionate production of information, other than communications data, for the purposes described above. The draft Regulation of Investigatory Powers (Communications Data) Order would give access to communications data to selected officers of the Maritime and Coastguard Agency for the purposes of protecting public safety and preventing and detecting maritime crime. Powers under section 259(2)(k) the Merchant Shipping Act 1995 to compel people to assist the Maritime and Coastguard Agency will be retained as they are used for other purposes not relating to accessing communications data. If the draft Order is enacted, these powers will not be used or attempted to be used for obtaining communications data. 1 Similar powers exist under sections 249 and 249 of the Road Traffic Act 1960 and section 56 of the Goods Vehicle (Licensing of Operators) Act 1995, due to legislative changes these provisions will soon be repealed.
