Mr. Rooker: As I have indicated in response to letters from right hon. and hon. Members who have raised the issue on behalf of
constituents, we have been considering how to make transitional arrangements. I am pleased to announce we are putting arrangements
in place to protect the position of those people who have periods of residence in Australia, on their return to live permanently in
the UK. We are protecting such periods of residence up to and including 5 April 2001 for the purpose of basic retirement pension and
bereavement benefits.
We shall, in advance of Primary Legislation, top up the pensions of people with residence in Australia prior to 6 April 2001 with an
extra statutory payment if they have less than the full rate of basic pension. We will do this when they claim their pension.
There will be no extra cost to public funds as we would have made such payments if the Agreement with Australia had continued. I am
arranging to write to all Members of both Houses who have raised the issue specifically with me.
We are protecting the basic pension position of people with residence in Australia before 6 April 2001.

Ms Armstrong: The non-domestic rate poundage (multiplier) will be 43 pence. The amount of non-domestic rates in England for 2001-02
to be redistributed to local authorities will be £15,137 million, although estimated payments into the pool in 2001-02 will be
£14,959 million. The Distributable Amount includes an allowance of £262 million for an Exchequer payment to the Non-domestic Rates
pool, to compensate for the shortfall which would otherwise occur as a result of the regulations under section 58 of the Local
Government Finance Act 1988 and the transitional relief scheme, announced on 25 November 1999, Official Report, columns 769-85.
The calculations for 2001-02, and the prior-year figures, on which this is based, are set out in the following tables.

Mr. Clifton-Brown: To ask the Secretary of State for Social Security, pursuant to his answer of 25 May 2000, Official Report, column
618W, how many people were denied Winter Fuel Payments because they were in temporary respite care from 20 to 26 September 1999;
what the cost would be of paying them Winter Fuel Payments; and for what reason the revisions to regulations were not applied in
respect of such people. [130126]
Angela Eagle: The information is not available in the format requested. Under the original Winter Fuel Payment scheme people living
in residential care or nursing homes who received Income Support or income-based Jobseeker's Allowance were not eligible for a
Winter Fuel Payment (unless they were a member of a couple admitted temporarily while their partner remained in the family home).
This provision was made on the basis that people in such situations were already receiving public assistance with their care
costs--which includes heating.
However, in the light of representations highlighting some difficult cases, we changed the eligibility conditions of the scheme. The
new provision means that people getting Income Support or income-based Jobseeker's Allowance and living in residential care or
nursing homes for a temporary period{1} are eligible for a Winter Fuel Payment based on their usual household circumstances.
The Social Fund legislation was amended in time to take effect for this coming winter's payments. We have no power to make
regulations retrospectively therefore the changes cannot apply to previous winters.
{1} `temporary' for the purposes of the Winter Fuel Payment scheme is less than 13 weeks by the end of the qualifying week.

Ms Oona King: To ask the Secretary of State for the Environment, Transport and the Regions if he will make a statement about the
programme for transferring existing organisations or parts of organisations to the Greater London Authority, London Transport Users'
Committee, Transport for London and the London Development Agency. [124187]
Mr. Hill: The transfers of existing bodies takes place on four main dates. As I announced in response to a question from my hon.
Friend the Member for Croydon, Central (Mr. Davies) on 1 April 2000, Official Report, columns 420-21W, the London Ecology Committee,
London Planning Advisory Committee and London Research Centre were abolished, and their staff, assets and liabilities were
temporarily transferred to the Secretary of State.
On 8 May these staff, assets and liabilities (other than those relating to a small number of London Research Centre staff who will
transfer later to Transport for London) transferred to the Greater London Authority (GLA), along with a small number of planning
staff from the Government Office for London, and the GLA Transition Team and staff newly recruited for the GLA.
Transfers to Transport for London (TfL) and the London Development Agency (LDA), and to the London Transport Users Committee (LTUC),
will take place on 3 July. On that date the following will transfer to TfL: London Regional Transport, excluding London Underground
Ltd. and some residual parts of LRT; the Traffic Control Systems Unit; the staff, assets and liabilities of the Traffic Director for
London; the Docklands Light Railway; the part of the Highways Agency dealing with London roads; certain roads from London boroughs
and the City of London; certain roads in Docklands from the Commission for the New Towns; the Public Carriage Office; a small number
of staff from the Government Office for London, and from the centre of the Department of the Environment, Transport and the Regions.
On the same date the following will transfer to the LDA: the London region staff of English Partnerships, and associated assets and
liabilities; some staff from the Government Office for London, together with staff newly recruited for the LDA.
On the same date the staff, assets and liabilities of the London Regional Passengers Committee will transfer to LTUC, which will
report to the Assembly of the GLA.
Most of the above transfers will be achieved through transfer schemes prepared under powers in section 409 of the GLA Act. In
preparing their transfer schemes, predecessor bodies are identifying which of their property, rights and liabilities, such as
buildings, contracts, staff or other assets, will transfer to the GLA's functional bodies and which will remain with the predecessor
body itself or be transferred elsewhere. Among other things, they will need to consider whether existing contracts can transfer in
their existing form or whether changes will be needed to meet the needs of the functional bodies.
In addition, those predecessor bodies, such as the Highways Agency, which are designated as Public Records bodies under the Public
Records Act 1958 will need to review those records which are intended to transfer to the functional bodies to see whether particular
records are worthy of preservation in the national archive. Predecessor bodies will also need to identify whether all of their
existing records are appropriate for transfer to the functional bodies, on the basis that all relevant records should transfer,
unless they identify any papers, such as advice to Ministers of the present and previous administrations, which would be
inappropriate for transfer. We expect that each predecessor body will identify very few, if any, papers which are unsuitable for
transfer. In conducting this exercise they will need to ensure that they take full account of existing and proposed freedom of
information legislation and the openness regime under which the GLA and functional bodies will operate.
Budgets for the GLA, TfL and LDA are as set out on 17 February 2000, Official Report, column 637W.
To permit the GlA, TfL and LDA to start functioning immediately on their respective start dates, orders to facilitate the transition
have been made under powers in sections 405 and 406 of the GLA Act. These enable the new organisations to make arrangements for
their financial operations and, where necessary, to prepare standing orders for their initial meetings. In addition temporary
appointments of certain statutory office holders in the GLA, TfL and LDA have been made by the Secretary of State using powers in
section 407 of the GLA Act.
To remove any doubts about the application of the Transfer of Undertaking (Protection of Employment) Regulations 1981 to transfers
of staff to the new organisations, an order has been made applying the 1981 Regulations to all transfers of staff by means of
transfer schemes or orders under the GLA Act powers. A further order added the new organisations to the list of bodies eligible to
be members of the Local Government Pension Scheme.

Mr. Sayeed: To ask the Secretary of State for the Environment, Transport and the Regions (1) what contingency plans he has made for
providing continuing cover for parking for disabled drivers if badges were not received by 1 April; [118735]
(2) he will make a statement on progress with the introduction of the new disabled parking badges. [118592]
Mr. Hill: The regulations to introduce the new blue parking badge for disabled people came into effect on 1 April.
Distribution of the new blue badges took place during the last week in March to local authorities who had placed orders. The
majority of those local authorities received badges ready for business on Monday, 3 April. However, owing to some technical problems
at the printer/supplier, some authorities did not receive the badges until Tuesday, 4 April.
My Department were informed by our supplier at the end of March that some local authorities had not placed orders for badges,
despite letters prompting them to do so from both the Department and the badge supplier. Officials have since written again to all
local authorities on this issue. From the checks we have carried out, and from the information provided by the supplier, we believe
almost all local authorities have placed orders and have received a supply of badges. We have, however, taken the precaution of
writing to ACPO (Association of Chief Police Officers) asking them to advise members not to take enforcement action against anyone
displaying an orange badge which expires in April which is otherwise being used in accordance with the regulations.
We regret that the transition has not been as smooth as we would have wished, but we hope the action we have taken will avoid any
distress or confusion for any disabled motorist who has difficulty getting a blue badge.

Mr. Hill: As part of the establishment of the Greater London Authority under the GLA Act 1999, the London Research Centre (LRC), the
London Planning Advisory Committee (LPAC) and London Ecology Committee (LEC) were abolished on 1 April 2000. At the same time, the
appropriate property, rights and liabilities of the three bodies were transferred by means of transfer schemes to the Secretary of
State for the Environment, Transport and the Regions. The intention is that these will transfer to the Greater London Authority on 8
May 2000, with the exception of a small number of functions of the LRC which will transfer to Transport for London on 3 July 2000.
I would like to take this opportunity to pay tribute to the very valuable work which the LRC, LPAC and LEC have each undertaken on a
wide range of cross-London subjects, since their establishment. I am confident that this tradition will be carried on by the Greater
London Authority itself in the future.

Mr. Ruffley: To ask the Secretary of State for the Environment, Transport and the Regions what recent representations he has
received regarding the level of business rates for small businesses. [112209]
Ms Armstrong: I have received representations from small businesses welcoming the transitional relief scheme announced on 25
November and calling for a rate relief scheme for small businesses.
The transitional relief scheme, which favours small businesses, will phase in significant changes in rate bills resulting from the
revaluation on 1 April. In addition many small businesses will benefit from the revaluation itself and the reduction in the
multiplier to 41.6p for every £1 of rateable value.
We set out a possible rate relief scheme for small businesses in our White Paper, "Modern Local Government: In Touch with the
People" (1998). We have discussed this scheme with representatives of small businesses, and we aim next to hold a public
consultation exercise on the details of the scheme.
