Chris Grayling: To ask the Secretary of State for Trade and Industry what her policy is on European legislation affecting the glass
industry. [30226]
Mr. Wilson: The glass and glazing industry covers a wide spectrum of DTI interests ranging from glass tableware to construction
materials. The Government therefore consider each proposed item of European legislation and the transposition and implementation of
adopted EU legislation on its merits and consults widely with interested parties. Legislation and regulations are implemented with a
light touch and in a way that maintains a broadly level playing field with other member states. The Government are particularly
concerned that extra costs should not be loaded onto UK businesses.

Chris Grayling: To ask the Secretary of State for Trade and Industry if she will make a statement on recent progress of negotiations
on the implementation of proposed European legislation on vehicle recycling. [30224]
Mr. Wilson: 116 responses were received to the DTI's consultation paper on options for implementing the end of life vehicles
directive and these are now being assessed, along with the recommendations and conclusions of the recent Trade and Industry
Committee report, to help the Government decide on the best means of transposition and implementation of the directive. We are
committed to achieving the important environmental objectives of the directive at least cost, and without putting UK business at a
competitive disadvantage.

Chris Grayling: To ask the Secretary of State for Trade and Industry in what circumstances a butcher's shop could be liable for
payments under the climate change levy. [12746]
Mr. Wilson: The climate change levy aims to increase energy efficiency across all sectors of business, including small food
retailers, and will help the UK to meet its commitments to reduce greenhouse emissions, including our Kyoto target. Those small
businesses, including butchers' shops, which have very low energy consumption below the minimum thresholds as defined in the Finance
Act 2000 are not liable to pay the climate change levy.
Businesses with energy use higher than the thresholds will be liable to pay the levy. However any such businesses can minimise their
levy bills by buying levy-exempt, green electricity, for example from new renewable sources; by taking advantage of energy
efficiency advice and support from the new Carbon Trust, which aims to take account of the needs of small businesses; or by
investing, using the new scheme of enhanced capital allowances for energy efficiency improvements (which covers items including
refrigeration equipment).

Chris Grayling: To ask the Secretary of State for Trade and Industry what plans she has to tighten the regulation of direct selling
by utilities. [12152]
Mr. Wilson: Direct selling is regulated under a range of consumer legislation. The Consumer Protection (Cancellation of Contracts
Concluded away from Business Premises) Regulations (The Doorstep Selling Regulations), govern doorstep sales and were strengthened
in 1998. New Distance Selling Regulations, governing telephone and internet sales, came into force in October 2000. Local Trading
Standards departments are responsible for the enforcement of these regulations. Breaches of the regulations that result in harm to
the collective interests of consumers could also be grounds for the courts to make a Stop Now Order requiring the company concerned
to cease the offending conduct. Under The Stop Now Order (E. C. Directive) Regulations, which came into force on 1 June 2001, the
power to apply for such Orders is held by the Director General of Fair Trading, local authority trading standards officers, and
sectoral regulators.
In the case of gas and electricity, the Office of Gas and Electricity Markets (Ofgem) introduced a Marketing Licence Condition in
1998 that governs the sales and marketing practices of suppliers. The Licence Condition was strengthened in January 2001. Ofgem
closely monitors the sales and marketing activities of suppliers, and, where necessary, it will take formal action against
individual suppliers.
In addition, I have recently written to all gas and electricity suppliers to express my concern about the distress caused by
incidences of sales malpractice and demand that suppliers improve their performances. Consumers affected by sales malpractice not
only form a negative view of an individual company, but also of the competitive market as a whole. It is in suppliers' own interests
to maintain the highest possible sales standards, to resolve problems rapidly where they occur and to ensure that the consumer is
content with the outcome.

Mr. Wilson: No decision has yet been taken on the precise method of transposing and implementing the options in the End of Life
Vehicles Directive. The period for responding to the DTI Consultation Paper on options closed on 2 November, and responses are now
being assessed. Consideration is being given to the potential impacts on all vehicle manufacturers.
