I am grateful to my right hon. Friend for his contribution, although I am not sure that it is fair to suggest, as he seems to do, that all those phenomena are the fault of the Electoral Commission. We are reforming the commission. We want it to improve its performance and we are confident that it will do so.

But did we not set up the Electoral Commission to consider these ideas? Since its creation, we have seen voting turnout decline, confidence in politicians fall, and the Council of Europe has criticised our postal voting. We give that outfit £27 million a year. Why?

Will my hon. Friend take evidence from Scottish councillors who are now enjoying—if that is the correct word—the single transferable vote electoral system? It means that we have more than one councillor a ward, and as a consequence, instead of one councillor being directly accountable to his or her constituents and visiting the community council, two or three have to turn up at gala day committees and such like. That has a very detrimental effect on their health.

I do not know what latitude the Minister has to look into the way in which European Union elections are operated. We have a problem with parliamentary elections for Westminster, but the turnout in European elections is much lower. Can he look into that so that we could perhaps return to the old system and, instead of the discredited proportional representation list system, we could have proper European constituencies, with one MEP representing one set of people?

I certainly agree with the hon. Gentleman on the first part of his question, because of course such matters are fundamentally important. However, I do not agree with the second part. We have always taken the integrity of the voting system seriously. The legislation that we have passed has had that absolutely at its heart, but we have a problem—as I hope the hon. Gentleman will recognise—with the disengagement of significant parts of the electorate from the political system. All of us owe it to our electorate to do whatever we can to increase participation. That is what has driven our reforms, and it will continue to drive our approach, but I can assure the hon. Gentleman that the integrity of the system remains fundamental.

Does the hon. Gentleman agree that whatever changes may be made to the voting system—this paper is clearly an important one—it also matters how the system of voting works? Does he also agree that the changes that his Government have initiated in the past have not been an outstanding success, and that one of the things that dignified our democracy in the past was the absolute integrity and assurance of our voting system? I thank my hon. Friend for that reply. In responding to the review, Ministers have said that it is an important contribution to the debate about the strengths and weaknesses of different voting systems, and the options for electoral reform. As the review is essentially desk research, it raises the question of where that debate will take place. Is there not now a case for asking voters—engaging the public in the debate—what kinds of different electoral systems can best contribute to different forms of politics and what they want from their political system in this country?

Is it not the case that this so-called review of electoral systems is actually little more than a cover for the Government's abject failure to address existing electoral issues, such as the need to counter rampant electoral malpractice, poor voter registration levels, hopeless electronic voting projects and the dire need for sensible party funding proposals?

Report, column 188W, regarding the Data Protection Act 1998, since when his Department has conducted a review of the operation of
the Data Protection Act 1998; and if he will place copies of the results of these reviews in the Library. [53426]
Mr. Wills: The Government started an appraisal of the Data Protection Act 1998 in September 2000 with a public consultation
exercise. The timing was geared to the European Commission's first report on the implementation of the EC Data Protection Directive
which was due in October 2001. That report has been delayed, and the Government have deferred completion of the appraisal of the
1998 Act until its timing is clearer. In December 2001 the Government published a summary of the responses to the September 2000
consultation. I am placing a copy in the Library.

Mr. Laurence Robertson: To ask the Parliamentary Secretary, Lord Chancellor's Department if he will make a statement on his plans to
reform the structure of the magistrates court system. [43459]
Mr. Wills: Sir Robin Auld's Review of the Criminal Courts in England and Wales makes wide-ranging recommendations in respect of the
magistrates courts. The period for comment closed on 31 January. The Government have taken no decisions on the report and is now
considering the recommendations in detail, taking account of the comments received. The Government will announce its conclusions by
way of a White Paper in the spring.

under the various international human rights instruments. [42171]
Mr. Wills: The Lord Chancellor's Department will conduct a review with the following terms of reference: "To review the United
Kingdom's position on international human rights instruments in the light of experience of the operation of the Human Rights Act,
the availability of existing remedies within the UK, and law and practice in other EU member states; and to report by spring 2003".
The review will consult widely within and outside Government. We hope to report the outcome in about a year's time.

Mr. Wills: Following a review in 1999, the fees for non-contentious probate were revised so that they more closely reflected the

Mr. Wills: I refer my hon. Friend to the answer I gave him on 4 February 2001, Official Report, column 712W, to his question number
32053. The Government are considering the recommendations in Sir Robin Auld's report and intend to publish a White Paper in the
spring.
The Court Service as an executive agency of the Department is currently undergoing a quinquennial review. That report will also be
published in the spring and its recommendations will be carefully considered by the Department.

Mr. George Howarth: To ask the Parliamentary Secretary, Lord Chancellor's Department, what proposals he has for reviewing the
operation of the Freedom of Information Act 2000; and what representations he has received on its operation. [32075]
Mr. Wills: The Freedom of Information Act 2000 is not yet fully in force. The Lord Chancellor set out his proposals for the
implementation of the Act in his report to Parliament in November 2000. When the Act is in operation, it is for the Information
Commissioner to draw to the Government's attention any changes to the Act she wishes to see, in her annual statutory report to
Parliament.
As the Act is not yet fully in force, no representations have been received on its operation.

Mr. Wills: The numbers of those who attended and those who registered but did not attend are included in the table. Registration was
refused only where the number booked had reached the capacity of the room. Because of the large non-attendance rate at London, "over
booking" was allowed for the events in Cardiff and Manchester.

Mr. Garnier: To ask the Parliamentary Secretary, Lord Chancellor's Department, what the results were of the evaluation undertaken by
the Review of the Criminal Courts Regional Discussion Events which have taken place to date. [R] [30799]
Mr. Wills: At each event delegates were handed an evaluation form. The results of the answers are as follows: 93 per cent. of
delegates who returned their evaluation forms believed that these events had value, 3 per cent. felt they did not and 4 per cent.
abstained. 72 per cent. of these delegates felt they had enough opportunity to air their views, 24 per cent. did not and 4 per cent.
abstained. 80 per cent. of delegates responding believed that the format of the event was effective, 13 per cent. felt that it was
not and 7 per cent. abstained from answering. 86 per cent. of delegates who returned their forms would attend another event such as
this, 11 per cent. felt they would not and 3 per cent. failed to answer. The number of returned forms varied at each event, for
example, only seven forms were returned at Cambridge whereas at Birmingham 101 were returned.
