I obviously understand the concern that my hon. Friend raises, but he will be well aware that Scotland is a separate jurisdiction in respect of civil law. It is therefore inevitable that differences will arise—that is a natural and inevitable consequence of devolution. I understand his frustration about the issue of pleural plaques in this country, which is widely shared, but we continue to look actively for a solution.

The proportion of foreign nationals in prisons in England and Wales is far lower than the European average. In most European countries, it is about 20 per cent. or much higher, particularly in southern European countries, so we are at the bottom of the league table, and I am glad that we are. On compulsory repatriation, the hon. Gentleman will know that it has been a long-standing practice of Governments, including those whom he has supported, for prisoner transfer arrangements to be subject to the consent of the prisoner. We are changing that practice, and the arrangements apply right across Europe.

I refer the hon. Member to the answer I gave him on 14 September 2009, Official Report, columns 2152-153W.In my written ministerial statement of 6 July 2009, Audit of Licence Revocation, Official Report, columns 34-38WS, I announced that, as at 26 June 2009, 954 offenders who had their licences revoked between 1984 and 31 March 2009 were not recorded as having been returned to custody. Of the 954, there were 192 foreign nationals. Of the 192, 64 were assessed as meeting the criteria for deportation.Over the last 10 years, more than 99 per cent. of offenders who have been recalled to prison have been successfully apprehended. We are determined to build on this creditable performance.All agencies are working together to review and revise the end-to-end recall process, to ensure that we have the strongest grip on these individuals and can return them to custody as quickly as possible. The police have an action plan in place to deal with outstanding cases.The Probation Service has significantly improved its enforcement of breaches. In 1997 only a third of breaches were being appropriately enforced, compared to over 95 per cent. by 2008. Before 1999 recall was rarely used because such cases had to go through the courts.

None of the offenders was subject to deportation or, therefore, taken into UK Border Agency custody. One of the three was released into approved premises; the other two were released into alternative accommodation, which had been risk-assessed by the probation service.All three were released subject to supervision on life licence by the probation service.There are 101 approved premises in England and Wales. Approved premises are used primarily to supervise certain high risk of harm offenders on release from custody. They provide for the kind of effective and close supervision of certain offenders which would be much more difficult to achieve if those offenders were dispersed into less suitable accommodation elsewhere in the community.

To answer the question would require a manual exercise checking every release of a mandatory and discretionary lifer during the period in question and this would incur disproportionate cost.However, since April 2007 the Public Protection Unit Database (PPUD) has recorded the nationality of prisoners being released. In 2007, there were three foreign national prisoners serving a mandatory life sentence and who were released from custody. There were no discretionary life sentence prisoners, identified as foreign nationals, who were released in 2007. As with any large scale recording system, it is subject to possible errors arising from either data entry or processing.Details of prisoners released are published "Offender Management Caseload Statistics" published by Offender Management and Sentencing Analytical Services, Ministry of Justice. This bulletin is available in the Library of the House and is available at:"http://www.justice.gov.uk/publications/statistics"The 2008 figures will be published in Offender Management Caseload Statistics 2008 at the end of July 2009. There have been two releases of foreign national prisoners serving indeterminate sentences of imprisonment for public protection since 4 April 2005. They were released after expiry of their tariff on the direction of the independent Parole Board, one in 2007 and one in 2009. Both were deported on release.

The proportion of our prisoners who are foreign nationals is low compared with those elsewhere in Europe. It is about 14 per cent., which compares extremely well with 60 per cent. in Austria and well over 30 per cent. in most other major European countries.

The percentage of foreign national prisoners (FNPs) in England and Wales prisons as at 30 June each year for the years 1994-2004 inclusive is in the following table. Number of FNPs and the total number of prisoners is included for completeness.

The National Offender Management Service, (NOMS), has a broad, integrated and evidence-based prisoner suicide prevention and self-harm management strategy that seeks to reduce the distress of all those in prison. This encompasses a wide spectrum of Prison and Department of Health work around such issues as mental health, substance misuse and resettlement. Any prisoner identified as at risk of suicide or self-harm is cared for using the Assessment, Care in Custody and Teamwork (ACCT) procedures. A prisoner-focused care planning system for those at risk, which, has helped prisons manage self-harm. Most self-harm is not directly life threatening, but nevertheless can be extremely distressing for those who have to deal with it. There are no easy answers to preventing self-harming behaviour but we remain committed to finding ways to manage it.Information on the total numbers of self-harm incidents is not available for the full time period requested (see table note). The following table details the estimated number of individuals who self-harmed from 2004 by type of nationality.
We do not specifically record whether foreign national prisoners died beyond the date that their sentence was due to expire. The numbers and proportions of self-harm incidents committed by foreign national prisoners in each of the last five years are detailed in the following table.

The National Offender Management Service, (NOMS), has a broad, integrated and evidence-based prisoner suicide prevention and self-harm management strategy that seeks to reduce the distress of all those in prison. This encompasses a wide spectrum of Prison and Department of Health work around such issues as mental health, substance misuse and resettlement. Any prisoner identified as at risk of suicide or self-harm is cared for using the Assessment, Care in Custody and Teamwork (ACCT) procedures. A prisoner-focused care planning system for those at risk, which, has helped prisons manage self-harm. Most self-harm is not directly life threatening, but nevertheless can be extremely distressing for those who have to deal with it. There are no easy answers to preventing self-harming behaviour but we remain committed to finding ways to manage it.Information on the total numbers of self-harm incidents is not available for the full time period requested (see table note). The following table details the estimated number of individuals who self-harmed from 2004 by type of nationality.
We do not specifically record whether foreign national prisoners died beyond the date that their sentence was due to expire. The numbers and proportions of self-harm incidents committed by foreign national prisoners in each of the last five years are detailed in the following table.

| 1. The NOMS incident reporting system processes high volumes of data which are constantly being updated. A new system for recording self-harm was introduced in December 2002 and as a result recording improved throughout 2003. Numbers since 2004 are, therefore, not comparable with those collected previously. | ||||||||||

Although care is taken when processing and analysing the returns, the detail collected is subject to the inaccuracies inherent in any large-scale recording system. The following table provides the numbers of prisoners held in all prison establishments in England and Wales as at 30 June in each year from 2004 to 2008, showing the percentage of foreign national prisoners:

The National Offender Management Service in the process of completing an audit of prisoners serving an indeterminate sentence of imprisonment for public protection and who are recorded centrally as being a foreign national. This audit is scheduled to be completed by the end of February, and I will write to the hon. Member, providing the data which he has requested and will place a copy of the letter in the Library.
