Mr. Clifton-Brown: To ask the Secretary of State for Environment, Food and Rural Affairs what steps her Department is taking to
combat fly-tipping. [224977]
Alun Michael: The Department is taking forward a wide ranging strategy for combating fly-tipping, in close liaison with the
Environment Agency and local authorities. Some new powers for these enforcement agencies were included in the Anti-social Behaviour
Act 2003. Many more provisions have been included in the Clean Neighbourhoods and Environment Bill which has now completed its
passage through Parliament. These include raising the penalties for the main offence of illegal waste disposal; new powers to stop,
search and instantly seize vehicles that are being used for fly- tipping; additional sentencing powers for the courts including a
power to award forfeiture of vehicles used to commit an offence; and powers for the enforcing authorities to issue fixed penalty
notices for some offences. We will work closely with the enforcement authorities on implementation of all the measures in the Bill.
100 per cent. of local authorities are now registered on the Flycapture database, which for the first time is producing
national data on the nature and scale of fly-tipping across the country. We are funding the Environment Agency through the
Flycapture Enforcement project to provide training for local authority enforcement officers and lawyers on how to enhance their
skills. Through the BREW programme, we are providing additional funding for the agency to assist businesses in complying with the
legal requirements on the disposal of waste. The Department has also just let a research project that will look in depth at the
reasons why people fly-tip and will develop good practice guidance for local authorities on further measures they can take to help
reduce the problem.

Miss McIntosh: To ask the Secretary of State for Environment, Food and Rural Affairs what measures her Department is taking to

Alun Michael: From 2007 large turkey producers (those with 40,000 or more places for turkeys) will be regulated under the Integrated
Pollution Prevention and Control regime. New installations are now regulated from the outset. Under the Integrated Pollution
Prevention and Control regime farming installations will have to comply with the Environment Agency's Standard Farming Rules and
Guidance for the poultry sector. In regards to manure spreading, turkey producers will be required to set up a manure management
plan for spreading turkey manure on their own farm. Turkey producers would also be required to identify the quantity--and the
nitrogen content--of manure if it is sent to another farm for land spreading.
Land spreading of organic manures in Nitrate Vulnerable Zones (approximately 55 per cent. of England) must comply with the
Action Programme that includes limits on nitrogen application, controls on spreading and periods when spreading cannot take place.
Guidelines for farmers are published by the Department, while enforcement action is with the Environment Agency. Outside of Nitrate
Vulnerable Zones, farmers are encouraged to comply with the advice in Defra's Codes of Good Agricultural Practice for the Protection
of Water, Air and Soil.
Where odour is a nuisance for those living in the vicinity of a farm where the spreading of turkey manure is practised, local
authorities can take action under the statutory nuisance regime of section 79 of the Environmental Protection Act 1990. Local
authorities have a duty to take reasonable steps, where practicable, to investigate complaints of odour. If a local authority
decides that an odour is prejudicial to health or a nuisance, an abatement notice must be issued, requiring that the activity
causing the nuisance cease, or that `best practicable means' be employed to reduce the level of odour. The penalty for
non-compliance with an abatement notice is a fine not exceeding £20,000 upon summary conviction.

Alun Michael: Defra has collected information on the land-spreading of organic manures, including turkey manure, in the 2003 British
Survey of Fertiliser Practice. Information collected in the survey included rate and timing of application and the allowance made by
farmers for the nutrient content of the manure.
Farmers located within Nitrate Vulnerable Zones are obliged to comply with an Action Programme of measures that includes
restrictions upon the rate and timing at which organic manure can be spread. The Environment Agency is the pertinent enforcement
body, and checks farm records to monitor compliance with the Action Programme.
In some cases the spreading of turkey manure may be subject to control under the Waste Framework Directive. On 9 December
Defra published a consultation paper on the draft Waste Management (England and Wales) Regulations 2005. These Regulations are
necessary to repeal the current exclusion in section 75(7)(c) of the Environmental Protection Act 1990 and to apply the
Directive's requirements to "agricultural waste". The consultation paper is available on the Defra website at

paragraphs 3.22-3.23 of the consultation paper.

Sue Doughty: To ask the Secretary of State for Environment, Food and Rural Affairs what assessment she has made of the use of

Alun Michael: A study by E4tech for the Department of Trade and Industry made the following estimates for the proportion of the UK's
electricity demand that could be met by 2020 from various types of waste biomass: 2.2 per cent. from the combustion,
gasification and anaerobic digestion of the organic fraction of municipal solid waste; 0.5 per cent. from the gasification
and anaerobic digestion of sewage sludge; 1.9 per cent. from the combustion and gasification of straw; and less than
0.2 per cent. each from food waste, wood processing waste, farm waste and forestry residues.
The Waste Implementation Programme was established last year to provide support to local authorities in assessing and establishing
alternative new technologies with particular reference to achieving the landfill diversion targets for biodegradable municipal
waste. The New Technologies sub-programme aims to establish up to five demonstrator plants by 2005 end with at least five additional
plants initiated by 2006.
Tallow derived from rendering animal by-products can be burnt to produce energy. 280,000 tonnes of tallow from animals slaughtered
under the over-30- months (slaughter) scheme have already been sold to renderers to power their boilers. The Rural Payments Agency
recently signed a contract to sell 110,000 tonnes of stockpiled tallow to a commercial company for energy production.
Around 120 million litres of waste vegetable oil are produced in the UK each year, which could produce about
115 million litres of biodiesel. 1 million litres of biodiesel from waste vegetable oil are currently sold each month
in the UK and it is likely that this will increase once the ban on used cooking oil in animal feed comes into effect in November
2004. Recent advances in biotechnology are opening up opportunities to produce bioethanol from ligno-cellulosic feedstocks such as
wood, straw and organic waste, using gasification and hydrolysis, although large-scale commercialisation is unlikely for some years.

Mr. Morley: I refer the hon. Member to the answer given on 14 January 2004, Official Report, column 740W. As that answer explained,
this year's review of national recycling targets will include consideration of whether to set further statutory recycling targets
for local authorities for the years beyond 2005-06. Although I cannot prejudge the outcome of that review, the Government's goal
will remain to encourage local authorities to continue to move management of municipal waste up the waste hierarchy in order to meet
their obligations under the Landfill Directive.

Alun Michael: None. The nature of dry cleaning operations makes it difficult to capture 100 per cent. of the various solvent waste
streams for recycling. The Solvent Emissions Directive (1999/13/EC) which aims at reducing emissions of volatile organic compounds
due to the use of organic solvents from certain activities and installations, including dry cleaning operations, does not include
specific requirements to ensure that a certain amount of the solvent waste stream should be recycled. Instead it controls releases
from the operation of the dry cleaning process as a whole by controlling the maximum amount of solvent that can be emitted per unit
mass of cleaned garments, that is emissions of waste gases and fugitive emissions to air, soil and water and solvents contained in
any products.
We intend to consult separately on proposals to include requirements on the operators to ensure that waste contaminated with
solvents are recycled or disposed of by waste licensed contracts. This will be in line with existing waste management regimes. There
are incentives within these proposals to encourage recovery of any residual solvent contained within the waste from dry cleaning
operations.
